Connecticut DEP Gives Final Approval

To Septic System at Mahackeno


The Connecticut DEP Commissioner Gina McCarthy gave final approval on Friday (8/3/07) to the Westport Weston Family Y’s septic system at Mahackeno.

Final approval had been delayed since March because Y Downtown filed an administrative appeal after the DEP gave the Family Y a draft permit to install a septic system at Mahackeno.

In her final approval, Commissioner McCarthy said, “the evidence in the record amply shows that the applicant [the Family Y] has complied with the applicable statutory and regulatory criteria.”

The commissioner found little merit in any of Y Downtown’s complaints about the Family Y’s proposal. Even though Y Downtown raised a number of issues,  they had been addressed by the Family Y.

“In fact,” said Ms. McCarthy in her final decision, “during the hearing proceedings, YDI’s attorney admitted that Mr. Bartos’ detailed testimony answered many of his questions, had resolved satisfactorily issues raised by his own expert witness, intended not to proceed with his expert witness and, indeed, YDI’s attorney never called any expert witness.”
